GENERAL PROVISIONS
The purpose of these General Terms and Conditions is the purchase of mobile phone accessories, made remotely via telematic network on the obastyle.com website owned by OUSAND S.r.l.
Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, as regards the protection of confidentiality, will be subject to the regulations set out in Law no. 675/96 and subsequent amendments.
Acceptance of the General Terms and Conditions of Sale
The customer, by sending electronic confirmation of his purchase order, unconditionally accepts and undertakes to observe in his dealings with OUSAND S.r.l., the present general conditions of sale, declaring that he has read and accepted all the information provided to him in accordance with the above-mentioned regulations, also noting that OUSAND S.r.l. does not consider itself bound to different conditions unless previously agreed in writing.
The contract is considered definitively concluded, except in cases of return or withdrawal, at the moment of delivery of the product to the Carrier. Prior to this moment, the availability of the product and receipt of the money is essential, if payment in advance has been chosen.
OUSAND S.r.l. reserves the right to cancel an order at any time, with prior notice to the buyer, for one of the following reasons
- the product ordered is out of stock (non-availability of the product)
- inability to receive payment authorisation (transaction denied);
- the customer does not meet the conditions listed in the General Terms and Conditions of Sale.
Commitments of the Customer
These General Terms and Conditions of Sale must be examined online by customers visiting the obastyle.com site before they confirm their purchases. The placing of an order confirmation therefore implies full knowledge of the General Terms and Conditions of Sale and their full acceptance.
The customer undertakes and is obliged, once the online purchase procedure is completed, to print and keep these General Sales Conditions, already viewed and accepted during the purchase process carried out, in order to fully comply with the condition set out in Articles 3 and 4 of Legislative Decree no. 185/1999.
Purchase modalities
The purchase of the products, available as they are illustrated and described online in the relevant detailed sheets, is made by the customer at the price indicated, plus any transport costs and, where applicable, also the collection costs.
The products are depicted and made visible on the obastyle.com Site in an accurate manner and corresponding to the characteristics actually possessed. In any case, OUSAND S.r.l. cannot guarantee the exact correspondence to reality in relation to the images and colours as they appear on the customer's monitor.
Before confirming the order, the customer will be given a summary of the cost of each product chosen and the transport costs.
Order
By confirming the order, upon completion of the contract, the customer will receive an order confirmation by e-mail containing all the details of the order. Upon acceptance of the order by OUSAND S.r.l., a further written communication will be sent to the customer with confirmation of order processing.
Prices
The prices shown on the Site obastyle.com are in euros and are shown exclusive of VAT. Transport costs are excluded.
The prices applied are those indicated on the site at the time the order is placed by the customer. The prices of individual products are subject to change and, therefore, the prices indicated on the site from time to time cancel and replace those previously indicated.
SHIPPING AND DELIVERY
The logistics partner chosen by the seller guarantees delivery within 24/48 hours in Italy and up to 72 hours in Europe. If an item is not in stock at the time of the order, the customer is notified as soon as possible, confirming the availability date or proposing an equivalent replacement product.
The cost of delivery is calculated automatically according to the weight of the products purchased (for Italy) or according to the product weight/destination country ratio (for non-EU shipments, to which the cost of customs formalities must be added).
Insurance of the goods during transport can be added, where foreseen and if chosen by the customer.
Delivery of products purchased through the seller's website can be made in the following ways:
Delivery to the Customer's home
The purchased products will be delivered by the courier identified by the seller to the shipping address indicated by the customer on the order with insured shipping, where applicable and if chosen by the customer.
Collection at the Seller's premises
If this option is provided, the purchased products can be picked up at OUSAND S.r.l. operational headquarters located in Rome at via Bernardino Alimena, 82, at no additional cost. The customer will be notified by e-mail as soon as the order is ready for collection.
PAYMENTS
Payment for the Products to be purchased through the Seller's website may be made in the following ways:
Credit Card or PayPal
Payment via PayPal account is immediate. By registering for free, a personal account is opened (using another current account, credit card or prepaid card such as Postepay), after which you can make or receive payments.
Using this means for Internet purchases offers the opportunity to act without having to give out one's data or credit card numbers in any way.
Payments can thus be made via one's Paypal account, Postepay, credit cards such as Visa or MasterCard, as well as prepaid cards belonging to the Visa Electron circuit.
Sending money is free of charge and afterwards the customer receives an e-mail confirming the payment made.
Bank transfer
The goods ordered on the obastyle.com website shall only be sent once the sum due has actually been credited, which shall be within 7 working days of the date of acceptance of the order. Beyond this deadline, the order shall be deemed automatically cancelled.
In the case of payment by bank transfer, the bank details and all necessary instructions will be sent by e-mail upon confirmation of the order.
RIGHT OF WITHDRAWAL AND LEGAL GUARANTEE OF CONFORMITY
Return for reconsideration
If the Product purchased through the obastyle.com Site does not satisfy the customer, the customer may return it to the seller, without having to specify the reason and without penalty, within 14 working days from when you received it.
In order to be able to return the product, the customer must, within the aforementioned deadline, contact Customer Care at the e-mail address info@obastyle.com or using the contact form on the Site, communicating his or her reconsideration. Before proceeding with the return of the product, the customer must wait for precise instructions.
After communicating his or her reconsideration, the customer must send the product he or she wishes to return in its original packaging to the address communicated by the seller. The costs for such shipment shall be borne by the customer.
Once the returned product has been received by the customer and its integrity has been verified, all sums paid to purchase it will be refunded, excluding shipping costs, within 30 days of the return of the goods.
If the product is found not to be intact, the customer shall not be entitled to a refund.
The return shipment, until the certificate of receipt, is under the complete responsibility of the customer. OUSAND S.r.l. is not liable in any way for damage or theft/loss of goods returned by uninsured shipments. In case of damage to the goods during transport, OUSAND S.r.l. will notify the customer of the incident, to enable him to file a complaint against the carrier and obtain any refund.
Conformity defects
For each Product purchased by a Professional customer, the latter will benefit from the guarantee for defects of the sold good, under the provision referred to in art. 1490 et seq. of the Italian Civil Code; the action to enforce the guarantee for defects of the Professional customer shall expire after 1 (one) year from the delivery of the purchased Product. The defects must be reported within 8 (eight) days of discovery.
INTELLECTUAL PROPERTY
All intellectual property rights in connection with obastyle.com (including its contents) are the exclusive property of OUSAND S.r.l. and its contents may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, linked and used for any purpose whatsoever without the prior written consent of OUSAND S.r.l.
COMPLAINTS AND DISPUTES
Any complaints should be forwarded to the following e-mail address info@obastyle.com or using the contact form on the Site. Civil disputes concerning the application, execution and interpretation of the distance sales contract are subject to Italian jurisdiction and the Court of Rome shall have jurisdiction.
